Competition Terms and Conditions

These Terms and Conditions (‘Competition Terms and Conditions’) apply to the Young Director’s Award (‘Competition’) organised by Global Village – Dubai LLC (‘GV’) and Bloom World Academy (‘BWA’).

ELIGIBILITY

  1. The Competition is open to individuals who:
    1. The Competition is open to individuals who:
    2. are over 18 (eighteen) years of age and the parent/legal guardian of (with full legal capacity over) a child aged 5-14 years old who is not already a student at BWA (“Candidate”); and
    3. meet any further eligibility requirements as outlined in the BWA Scholarship Programme Terms and Conditions, as annexed hereto as Appendix A (‘BWA Terms and Conditions’).
  2. The following individuals are NOT eligible to participate in the Competition:
    1. Anyone who already has a child currently enrolled at Bloom World Academy, and their siblings.
    2. GV and Dubai Holding Entertainment employees and their immediate family members.
    3. BWA employees and their immediate family members.

AGREEMENT TO TERMS AND CONDITIONS

By entering into the Competition, you:

  1. Confirm that you have read and accepted these Competition Terms and Conditions;
  2. Agree to be fully and unconditionally bound by these Competition Terms and Conditions and any amendments to them;
  3. Represent and warrant that you meet the eligibility requirements; and
  4. Accept the decisions of GV, as they relate to the Competition, as final and binding.

COMPETITION

  1. In order to enter the Competition, participants must:
    1. Candidate to create a short film (minimum 2 minutes and maximum 4 minutes long) on the theme “My More Wonderful World” (“Video”). The Video needs to show how the Candidate, or someone they know, is helping to make the world a better place. It could be a friend, a teacher, a family member or someone in their wider community who is helping make a positive impact to the world by doing something amazing, big or small;
    2. Upload the Video on YouTube as “unpublished”;
    3. Complete the application form through the registration page: https://globalvillage.ae/en/young-directors-award and include the YouTube link to the video. Incomplete registration forms will be considered null and void.
  2. Submissions will be accepted from 16:01 on 9th January 2023 until 24:00 on 8th February 2023- UAE standard time (i.e. GMT +4). No submissions will be accepted after that time.
  3. Only one (1) application into the Competition per Candidate.
  4. Further information, documentation and assessment may be required to be submitted directly to BWA from time to time.
  5. All submitted Video(s) must not contain any tag(s), signature(s), initial(s), frame, border(s), logo(s) or any other references and/or marks added by the participant.
  6. Videos that portray or otherwise include inappropriate and/or offensive contents, will be disqualified.
  7. GV reserves the right to reject any entry into the Competition without any explanation or prior notice.

PRIZES

  1. BWA is offering the following prizes to the selected winning entrants to the Competition:
    1. Junior Category (Grade 1 to Grade 5) – Scholarship offered by Bloom World Academy
    2. Senior Category (Grade 6 to Grade 9) – Scholarship offered by Bloom World Academy
  2. Global Village is offering one (1) smartphone to the first selected Junior Category winner and one (1) smartphone to the first selected Senior Category winner.
  3. The offering of a scholarship is subject to the BWA Terms and Conditions.
  4. Participants understand that the prize is an offer of scholarship only, such offer to be on the terms and conditions dictated by BWA.
  5. Acceptance, award and administration of scholarships are a matter for agreement between BWA and the winning participant(s). GV involvement is limited to the organisation of the Competition only.
  6. Any federal, state/ provincial/ territorial, and/or local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income tax) on any prize that may be awarded under the Competition will be solely paid by you.
  7. If, for any reason, the Competition is not capable of being conducted as anticipated, due to computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of GV, GV reserves the right at its sole discretion to cancel, terminate, modify or suspend the competition as deemed appropriate, disqualify any participant, and/or select winners from all eligible video(s) submitted prior to the termination, cancellation, modification or suspension. GV reserves the right to correct any typo-graphical, printing, computer programming or operating errors at any time.

WINNER SELECTION

  1. All submissions will be shared with a BWA selection committee (“Committee”). The Committee will review the videos and shortlist the best submissions.
  2. The shortlisted participants will be contacted by BWA and invited to meet the Committee to present their submission and confirm their scholarship eligibility. BWA will require shortlisted participants to comply with the requirements of the BWA Terms and Conditions, and to provide such other further information as is necessary to assist BWA in making its decision.
  3. Further to the presentations, the Committee will select the finalists.
  4. The finalist submissions will then be submitted to the Young Director’s Award jury (“Jury”).
  5. The Jury will evaluate and select the winning participants for the Junior Category and for the Senior Category.
  6. All finalists will be invited to attend the screening and award ceremony to take place at Global Village where the winners will be announced.
  7. The Committee and the Jury has the right, at its absolute discretion, to turn down or reject any and all Candidates without having to give any notice or explanation to the relevant participant.
  8. The decision of the Committee and the Jury is final and binding on all participants in respect to all matters relating to the Competition winner and offering of the prize.
  9. Non-winners will not be notified.

INTELLECTUAL PROPERTY AND RELEASE

  1. The Video must be a single work of original material created by you and the Candidate. It must not contain any materials owned or controlled by a third party for which you have not obtained a license, permission or approval for use in accordance with these Competition Terms and Conditions and Release. Note that it is a legal requirement that you only film people with their (or their parent’s) prior content.
  2. Videos must not infringe the copyright, trademark, moral rights, rights of privacy/publicity or any intellectual property rights of any person or entity.
  3. You must obtain the consent from every individual that appears in the Video for GV to use the footage of them:
    1. The consent form for adults who appear in the Video can be found here (Adult consent form).
    2. The consent form for parents/guardians to sign on behalf of children who appear in the Video can be found here (Minor consent form)
  4. You must obtain, at your own cost, and provide GV within three (3) calendar days of any request to do so, any or all of the following confirming the above points:
    1. A signed written consent, release and/or permission for each and every identifiable individual person appearing in the submitted video(s);
    2. A signed written license from the copyright owner of any copyrighted material that appears in your submitted video(s);
    3. A signed written license from the owner of any private property included in your submitted video(s); and
    4. A signed written license or release letter from a person who has the right or is able to assert any right over the video(s) (e.g. employer, agency, etc.)
  5. You grant to GV, a perpetual, worldwide, non-revokable, non-exclusive, royalty free, sub-licensable right and license to use, publish, reproduce, display, perform, adapt, modify, create derivative works, distribute, have distributed and promote the Video, in whole or in part, in any form, in all media forms now or hereafter known, anywhere in the world and for any purpose, including but not limited to: display at a potential exhibition of winners, or online highlighting entries or winners of the competition, and promoting the work of GV and BWA generally.
  6. You hereby consent, on behalf of the Candidate, to the use of the Video containing footage of said child, in the manner contemplated above.

RELEASE AND CONSENT

You agree to the contents of the Consent and Release Form.

LIABILITY

  1. By entering the Competition, you agree, to the fullest extent permitted by law, to hold harmless, release, indemnify and discharge GV and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers and representatives from all liability, claims, judgments, demands, controversies, agreements, damages, actions and causes of action whatsoever, arising out of or related in any way to the video(s), the Competition or the conduct of the Competition and the acceptance and use, misuse, or possession of any prize awarded, whether in law or in equity, no matter what the cause or nature, and you further waive any claims that you may state or assert against GV in association with the Competition or any of its associated activities, or in any way related to or resulting from the video(s), competition even if such injury or claims results from or is caused by the negligence or gross negligence of GV or BWA, in whole or in part. You further agree to indemnify and hold harmless GV from any claim arising out of your participation in the Competition including, without limitation, all claims brought or asserted by any third party as a result of any injury or loss that you or they may sustain in any way associated with your participation in the Competition.
  2. If GV, in its sole discretion, is of the opinion that you have breached any of the Competition Terms and Conditions, we have the right to disqualify you from the competition, and in such circumstances you must re-pay to GV all costs incurred in relation to your submission(s) and participation in the Competition, including but not limited to (if and to the extent applicable) any travel costs incurred, and re-pay the competition prize money and return any trophies or certificates at your own cost.
  3. Under no circumstance will GV be liable for any:
    1. lost, late, misdirected, stolen, illegible or incomplete submissions.
    2. error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, submitted video(s);
    3. problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the internet, at any website, or on account of any combination of the foregoing.
    4. incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilized in the competition or by any technical or human error which may occur in the processing of the video(s) and/or the submissions; and/or
    5. injury or damage to any participant or to any computer related to, resulting from or in connection with the Competition.

GENERAL

  1. GV accepts no responsibility or liability for any damages, costs or expenses an applicant may incur as a consequence of any failure to award or delay in awarding any prize and/or scholarship for any reason.
  2. You hereby consent on your own behalf and on behalf the Candidate for GV and any employees, officers and affiliates to use and disclose (to the fullest extent permitted by applicable law your and your child’s name, city and state of residence, photograph, any oral or written statements, footage, and/or likeness for advertising, trade and/or any other purposes in any media and/or social media and/or on TV now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification.
  3. GV and BWA are both hereby granted authorisation and consent to conduct any and all verifications required concerning participants’ and winner’s identity. GV and BWA reserves the right to verify participants’ eligibility at any time, including requiring photographic identification, proof of age and residency.
  4. GV reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Competition and the Competition Terms and Conditions (or portion thereof) without any notice to participants, at any time and for any reason whatsoever especially if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Competition or for any other reason.
  5. Failure by GV to enforce any of its rights under these Competition Terms and Conditions, at any stage, does not constitute a waiver of those rights.
  6. Should any provisions of these Competition Terms & Conditions become illegal or unenforceable, such illegality or unenforceability shall not affect the remainder of these Competition Terms and Conditions to the fullest extent permitted by law, unaffected and valid. The illegal or unenforceable provisions shall be replaced by a valid and enforceable provisions which best reflects GV’s intentions in a legal and enforceable manner with respect to the invalid or unenforceable provision or portion thereof.

GOVERNING LAW

The Competition and the Competition Terms and Conditions shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The Courts of Dubai shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and/or to settle any disputes, which may arise out of or connection with the Competition. Notwithstanding the foregoing, GV may seek injunctive or other equitable relief to protect our rights in any court of competent jurisdiction.

Appendix A

BLOOM WORLD ACADEMY SCHOLARSHIP PROGRAMME –
Terms and Conditions
INTRODUCTION

Bloom World Academy offers Academic Scholarships to students who consistently demonstrate academic excellence, leadership skills, and model exemplary attitudes towards their learning. We are looking for those students who ‘dare to be different’, and have the passion and commitment to continue improving their grades through, but not limited to, the following attributes:

  1. Exceptional academic potential
  2. Demonstrate commitment to academic, co-curricular activities or community activities
  3. Showcase creativity and an entrepreneurial mindset
  4. Exemplify IB Learner Profile attributes
  5. Passion for languages
  6. Change maker
  7. Societal leader in the making

  1. APPLICATIONS AND OFFER LETTERS
    1. 1.1 These terms and conditions (the Terms) shall:
      1. Apply to all participants in the competition; and
      2. Apply to any Award of Scholarships made by Bloom World Academy, unless expressly stated otherwise in any Offer Letter.
    2. 1.2 By entering the competition or Accepting an Offer Letter you agree to be bound by the terms and conditions set out herein.
    3. 1.3 Further terms and conditions may be set out in an Offer Letter applicable to a particular Award.

  3. APPLICATION PROCEDURE
    1. 2.1 Scholarship candidates will be considered based on submission of:
      1. ‘My more wonderful world?’ short film based on Bloom World Academy’s vision ‘First, Best, Different’;
      2. fully completed completion Application Form
        Shortlisted participants will be required to complete the following:
      3. submit supporting documentation as specified by the Scholarship Committee as being required, including but not limited to;
        1. academic progress reports from the Student’s current school (both local and national benchmarks);
        2. the results of a verbal and non-verbal reasoning assessment to be completed by the Student (CAT4);
      4. an interview with a selection committee to assess the Student’s calibre and commitment.
        Applications will not be considered if the required information and/or documents are incomplete or not submitted upon request.
    2. 2.3 Bloom World Academy accepts no responsibility or liability for any damages, costs or expenses an applicant may incur as a consequence of any failure to award or delay in awarding any Scholarship for any reason. In order to be eligible to receive any Scholarship all candidates must meet the established enrolment criteria for the Awarding School.
    3. 2.4 There are a limited number of Scholarships available. Scholarships will be awarded based on availability, merit and performance abilities. Scholarships are granted, renewed and withdrawn at the sole discretion of Bloom World Academy. The Scholarship Committee's decision will be final and binding.
    4. 2.5 Before final selection, candidates will be interviewed by the Scholarship Committee, including the Principal.
  4. ACCEPTANCE OF A SCHOLARSHIP
    1. 3.1 Scholarships shall be offered to the winning participants in writing via an official letter (Offer Letter).
    2. 3.2 Awards shall be accepted by Offer Recipients in accordance with the terms of the applicable Offer Letter. In particular, an Award must be accepted by the date indicated in Offer Letter. If the Offer Recipient declines or does not take up the Award within such timeframe, Bloom World Academy may revoke the Offer Letter and may, in its sole discretion, award the Scholarship to another candidate.
    3. 3.3 The terms of the Award and the Scholarship as specified in the Offer Letter are non- negotiable.
    4. 3.4 It is a requirement of each Award that an Offer Recipient is fully registered and enrolled with Bloom World Academy no later than three (3) weeks prior to the commencement of the Academic Year, and remains so for the duration of the Scholarship. Where an Offer Recipient fails to register with Bloom World Academy in respect of its programme of study by such date, Bloom World Academy reserves the right to revoke the Offer Letter and the Scholarship with immediate effect.
    5. 3.5 In the event that there are outstanding tuition fees or other amounts payable to Bloom World Academy by the parents or legal guardians of payable of an Offer Recipient ("Outstanding Fees") the Award shall not be capable of Acceptance until such Outstanding Fees have been discharged. In the event that Outstanding Fees accrue during any Academic Term during the Academic Year to which a Scholarship relates Bloom World Academy may, at its sole discretion, cancel the Scholarship in respect of all subsequent Academic Terms, unless the Outstanding Fees are paid by the end of the Academic Term to which they relate.
  5. FORM OF SCHOLARSHIPS
    1. 5.1 It is acknowledged and agreed that any and all Scholarships will be awarded on the basis of a full concession to the tuition fees that would otherwise be payable in respect of the Student for the Academic Year in relation to which the Scholarship has been awarded. Scholarships shall not apply to, be set-off against or reduce any other fees or payments that may be payable to Bloom World Academy or any third party (including any registration fees, government or municipality fees, the cost of any uniforms, books, transportation, extra- curricular activities, curricular or extra-curricular trips, camps or expeditions) in relation to a Student's enrolment.
    2. 5.2 In no circumstances shall any Scholarship Award be exchangeable for cash in part or in full.
    3. 5.3 Unless expressly stated in the Offer Letter, any Scholarship shall take the form of a full concession to the benchmark tuition fees (as advertised on www.bloomworldacademy.ae) that would otherwise be payable by a Student.
    4. 5.4 Scholarships are not transferable and cannot be accelerated to an earlier date or deferred to a later date.
  6. TERM AND RENEWAL OF SCHOLARSHIPS
    1. 6.1 Each Scholarship is awarded for the entirety of the student’s enrolment at Bloom World Academy until such time that they withdraw or graduate, subject to annual reapproval by the Scholarship Committee following review of end-of-year academic results to ensure the Scholarship offer criteria continue to be met.
  7. WITHDRAWAL OF SCHOLARSHIPS
    1. 7.1 In order to be eligible to receive any Scholarship all Students must continue to be registered and enrolled with Bloom World Academy throughout the Academic Year/s to which the Scholarship relates. In the event that a Student ceases to be registered or enrolled with Bloom World Academy at any time during the term of their Scholarship, Bloom World Academy may revoke the Scholarship with immediate effect.
    2. 7.2 In the event that Outstanding Fees accrue during any Academic Term during the Academic Year/s to which a Scholarship relates Bloom World Academy may, at its sole discretion, cancel the Scholarship in respect of all subsequent Academic Terms, unless the Outstanding Fees are paid by the end of the Academic Term to which they relate.
    3. 7.3 It is acknowledged and agreed that each Scholarship is awarded subject to the Student:
      1. demonstrating expected academic progress and continuous improvement in the specialist area for which the Scholarship was awarded; and
      2. meeting attendance requirements as identified in Bloom World Academy’s student handbook;
      3. meeting Bloom World Academy’s behavioural standards as defined in the student handbook;
      4. agreeing to represent Bloom World Academy in their area of specialism;
      5. demonstrating model student behaviour towards their peers, teachers and other adults; and
      6. Satisfying any other criteria set out in the Offer Letter (the "Offer Criteria").

        If at any stage Bloom World Academy determines in their sole discretion that the Student has failed to meet any Offer Criteria, then Bloom World Academy may withdraw the Scholarship with effect from the commencement of the following Academic Term.

    4. 7.4 Bloom World Academy reserves the right to withdraw a Scholarship immediately and without notice to the Student where it is determined by Bloom World Academy that such Student has misled Bloom World Academy about any aspect of their eligibility to receive the Scholarship. Under any such circumstances, Bloom World Academy shall be entitled to seek repayment of any portion of the benefit of a Scholarship which has been availed by the Student prior to such determination.
  8. PUBLICITY AND PROMOTION
    1. 8.1 In accepting any Award each Student (and their parents and legal guardians) hereby expressly consents and grants express permission to Bloom World Academy and such persons as Bloom World Academy may authorise from time to time to use the Student's name, image and any applicable case study information in any publication, marketing, or advertising associated with Bloom World Academy and/or the Scholarship (including but not limited to the Bloom World Academy website, social media channels, print and electronic media). Each Student agrees to ensure that Bloom World Academy is regularly updated in the event that there is any change to the Student's relevant contact details, and that Bloom World Academy holds a non- School email address through which the Student (or their parents or legal guardians) can be contacted at all times.
    2. 8.2 Students may be required to attend internal and external events held by Bloom World Academy and photos and videos of Students at the event (along with their name, school and Scholarship), may be used for promotional purposes by Bloom World Academy and / or our partner organisations, including but not limited to Bloom World Academy’s website, social media channels, print and electronic media.
    3. 8.3 Students may be required to attend and represent Bloom World Academy in any national or international competition relevant to their area of excellence.
    4. 8.4 Each Student waives the right to inspect or approve the finished product, the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. If a Student does not wish for their details to be passed on to media or used for promotional purposes, they must notify Bloom World Academy in writing.
    5. 8.5 Each Student hereby consents to Bloom World Academy contacting them at any time following completion of the Student's studies to seek updates regarding how the Scholarship may have impacted upon or influenced the Student's career.
    6. 8.6 Each Student acknowledged that in the course of administering the Scholarship Bloom World Academy may have access to certain confidential information about the Student. Bloom World Academy undertakes to use all reasonable endeavours to keep such information confidential and not to share such information with any third party without the Student's prior consent. Each Student hereby agree that nothing in these terms and conditions shall be taken to prevent Bloom World Academy from making any disclosure required under any laws in any jurisdiction.
  9. CHANGES TO THESE TERMS
    1. 9.1 Bloom World Academy reserves the right to amend or make changes to these Terms at any time where such a change arises as a result of changes in regulations or legislation affecting all or any of the Scholarships.
    2. 9.2 Bloom World Academy may unilaterally amend or make changes these Terms by giving any candidate, Student (or their parents / legal guardians) at least one (1) month’s written notice of Bloom World Academy’s intention to do so. In the event that Recipients do not wish to accept any such revised terms, Recipients reserve the right to terminate this Agreement by written notice to the School.
  10. MISCELLANEOUS
    1. 10.1 If the whole or any part of any provision of these Terms are void or unenforceable in any jurisdiction, the other provisions of these Terms, and the rest of the void or unenforceable provision, will continue in force in that jurisdiction, and the validity and enforceability of that provision in any other jurisdiction will not be affected.
    2. 10.2 These Terms shall be interpreted according to the laws of the United Arab Emirates.
  11. DEFINED TERMS

    In these Terms the following defined terms shall have the following meanings:

    Academic Year means the Academic Year of Bloom World Academy.

    Academic Term means each term of the Academic Year of Bloom World Academy.

    Accepted means the candidate's parent or legal guardian having counter-signed the Offer Letter and Acceptance shall have the corresponding meaning.

    The award means an offer of a Scholarship on the terms set out in an Offer Letter (which shall be deemed to incorporate these Terms).

    Scholarship Committee means the committee formed for the purpose of assessing applications for and awarding Scholarships.

    Offer Letter has the meaning given in Clause 3.1

    Offer Recipients has the meaning given in Clause 3.1

    Student means a candidate who has received and Accepted and Offer Letter.

    Scholarship means a scholarship offered by Bloom World Academy to the existing or prospective students of its schools.
